Individual retirement accounts, or IRAs, are a fundamental part of planning for retirement for many Americans. In 2022, it was estimated that the value of the assets held in these accounts was around 10.1 trillion U.S. dollars.
Both traditional and Roth IRAs receive a degree of legal protection, as established in the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) of 2005. While accounts are currently only protected up to $1,512,350, courts can provide higher or lower protection if a judge determines it is suitable to do so.
This protection might seem quite generous at first, however, they are not unconditional. IRAs and other retirement accounts can be at risk of seizure in certain circumstances, such as if the owner is convicted of a crime or goes through a divorce. Additionally, funds held in an inherited IRA receive no protection under the federal law.
Offshore Asset Protection is available for IRAs

The funds in a self-directed IRA can be moved to an Offshore Limited Liability Company (LLC), thus removing the assets from the jurisdiction of the U.S. courts.

How does it work?
The Offshore Asset Protection for IRAs works by using an offshore IRA custodian. Then a newly formed single member LLC is established in the selected offshore jurisdiction. All of the IRA assets are transferred inside this new offshore LLC. In exchange, the IRA receives a 100% ownership in the offshore LLC.
This results in the IRA account being fully invested in the offshore LLC and now the LLC can in turn hold various investments. The account is then held under the management of an offshore manager.
Once the LLC is managed by a firm outside the United States, it is not subject to the jurisdiction of a U.S. court. The governing laws and company bylaws prevent the manager of the LLC from distributing any of the assets even if ordered by a U.S. court. Only a voluntary request, under penalty of perjury, from the account owner can authorize a distribution under the governing documents.
